Brazilian Law: Ricardo Tosto, a Respected Lawyer in Brazil

Brazil is a civil law country. The country’s legal system comes from Portuguese, Italian, French German, and Roman civil law. Brazil is a federative country formed by the union of the states, the Federal District, and municipalities. Their legal system is based on codes that are enacted by the federal government and also legislatures from the states and municipalities.
Brazil has the largest number of lawyers in the world. In 2007, there were 1,024 courses of Law in the country, with more than 150,000 law students. Law schools are spread all over the states of Brazil. In 2010, the state of São Paulo had 222,807 lawyers, Rio de Janeiro had 112,515 lawyers, and Minas Gerais had 63,978 lawyers; totaling to 621,885 lawyers in the country.

For one to practice law in the country, they are required to spend five years in law school. Upon graduation, the student must pass the Ordem dos Advogados do Brasil (the examination of the Bar Association of Brazil). The Brazilian Bar Association administers the Bar examination. The examination takes place thrice a year, usually in January, March, and September.

The examination is administered in two phases: the multiple choice questions and the written test. The multiple-choice test covers all disciplines (Administrative Law, Ethics, Philosophy of Law, Criminal Law, Human Rights, Constitutional Law, Civil Law, Consumer Law, Criminal Procedure Law, Labor Law, and Labor Procedure Law). Students must get at least 40 questions right to proceed to the next part of the examination.

The second part of the examination is the written test. It covers four essay questions and a drafting project in Administrative Law, Civil Law, Constitutional Law, Labor Law, Criminal Law, and Tax Law. Students who succeed in the examination can practice law in the country.

Mr. Ricardo Tosto 11 of March of 1963 ) is a respected lawyer in Brazil. He obtained a degree in law from Mackenzie University. Tosto has an extension course in Business Administration from Fundação Armando Alvares Penteado. Tosto started his career in a small room, and a few years later, he positioned his office among the largest law firms in Brazil.
